Participant Waiver, Release of Liability, Assumption of Risk, and Registration Agreement

1. Acknowledgment and Assumption of Risk

I understand that participating in the Friendswood Turkey Trot & Festival, including the 5K Run/Walk, 10K Run, Kids 1K Fun Run, and related activities (collectively, the "Event"), involves inherent risks.

These risks include, but are not limited to, falls, collisions with other participants, uneven surfaces, road conditions, vehicle traffic, weather conditions, dehydration, physical exertion, and the actions or omissions of other participants.

I voluntarily assume the risks associated with my participation, including the possibility of serious injury, illness, disability, death, or property damage.

I understand that Event organizers may modify the course, schedule, or activities when necessary for participant safety.

2. Release of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE TEXAS LAW, I RELEASE, WAIVE, AND DISCHARGE RUN WITH FRIENDS, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, CONTRACTORS, EVENT SPONSORS, AND THEIR RESPECTIVE REPRESENTATIVES (COLLECTIVELY, THE "RELEASED PARTIES") FROM CLAIMS ARISING FROM MY PARTICIPATION IN THE EVENT, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

I UNDERSTAND THAT THIS RELEASE IS INTENDED TO APPLY EVEN WHEN AN INJURY OR LOSS IS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, TO THE EXTENT SUCH A RELEASE IS ENFORCEABLE UNDER TEXAS LAW.

This agreement does not purport to release claims that cannot lawfully be waived.

3. Participant Health and Safety

I acknowledge that I am responsible for determining whether I am physically capable of participating in my selected event.

I agree to:

• Follow instructions from race officials, volunteers, police officers, and emergency personnel.
• Remain on designated event routes.
• Exercise reasonable care for my own safety and the safety of others.
• Comply with applicable event rules and safety procedures.

I understand that Event officials may prevent or discontinue my participation when they reasonably determine that continued participation presents a safety concern.

4. Emergency Medical Treatment

In the event of an injury, illness, or medical emergency, I authorize Event personnel to seek appropriate emergency medical assistance on my behalf when reasonably necessary.

I understand that Run With Friends does not guarantee the availability of medical personnel or services.

I acknowledge that I may be financially responsible for medical treatment, transportation, and related expenses, subject to applicable law and insurance coverage.

5. Minor Participants and Parental Consent

For participants under 18 years of age, registration must be completed or authorized by a parent or legal guardian.

As the parent or legal guardian, I:

• Consent to the minor's participation in the Event.
• Acknowledge the risks associated with the minor's participation.
• Agree to communicate applicable Event rules and safety instructions to the minor.
• Authorize Event personnel to seek emergency medical assistance for the minor when reasonably necessary.

The Kids 1K Fun Run is intended for children ages 12 and under. One parent or guardian may accompany a participating child without purchasing a separate race registration. Accompanying adults are not entitled to participant shirts or finisher medals.

Any release of claims involving a minor is intended to apply only to the extent permitted by Texas law.

6. Photography and Media

I understand that photographs, video recordings, and other media may be captured during the Event.

I grant Run With Friends permission to use photographs and recordings depicting me in connection with legitimate Event activities, including results, reporting, promotion, and future Event marketing, without compensation.

For minor participants, this permission is granted by the registering parent or legal guardian.

This provision does not authorize the disclosure of confidential registration information.

7. Registration Fees, Refunds, and Transfers

I understand and agree to the following registration policies:

General Refund Policy

Registration fees are generally nonrefundable, except as expressly provided below or required by applicable law.

Participant Transfers

Participants may transfer their registrations to another eligible individual through RunSignup, subject to published deadlines, eligibility requirements, and applicable processing fees.

Event Distance Changes

Participants may change to another eligible Event distance through RunSignup before the published cutoff.

The amount paid toward the original event registration may be credited toward the new event. If the new registration costs more, the participant is responsible for the difference and applicable processing fees. Unused credit is not refundable.

Cancellation Due to Required Government Approvals

The proposed 5K and 10K courses require final street closure authorization from Friendswood City Council, currently scheduled for consideration on November 2, 2026.

If the required authorization is not obtained and the Event cannot proceed, Run With Friends will issue full refunds of registration fees, including applicable registration processing fees.

Other Cancellations or Modifications

Run With Friends reserves the right to modify, postpone, or cancel the Event when reasonably necessary due to severe weather, emergencies, public safety concerns, government directives, or other circumstances beyond its reasonable control.

Refunds for such circumstances will be determined according to the Event's published policies and applicable law.

8. Event Rules and Conduct

I agree to comply with all published Event rules and reasonable instructions from Event officials.

I understand that:

• Race bibs may only be transferred through authorized registration procedures.
• Participants must follow the designated course.
• Event officials may remove participants whose conduct presents a safety risk.
• Course routes, start times, and Event activities may be modified when necessary.

9. Acknowledgment and Agreement

I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND VOLUNTARILY AGREE TO ITS PROVISIONS, INCLUDING THE ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND REGISTRATION POLICIES.

I understand that this agreement may affect my legal rights.

If registering a minor, I certify that I am the minor's parent or legal guardian and have authority to consent to the minor's participation.

By completing registration and accepting this waiver electronically, I indicate my agreement to these terms.
